A business dispute may have been the result of a simple misunderstanding, but emotions soon play a part and, before you know it, a resolution is nowhere in sight. If this is the case, you may be considering heading to court to resolve your business dispute.
But before you do, you may want to consider business mediation. It’s a cheaper, quicker option that can resolve your issue without the need of attorneys or dealing with the court system.

Mediation Services for Small Businesses
When a conflict arises in your business, you may be considering litigation. However, this can be an expensive and time-consuming endeavor—you’ll have to deal with court costs and attorney fees for a case that could take years to resolve. Litigation is something that many small businesses simply cannot afford. The good news is that there’s an alternative solution: mediation.
Mediation can help you and the other party come to a resolution without the need for going to court. Since the two parties are sharing the cost of the mediator, the expenses are much lower, even if you hire a mediator on a per-hour basis. Best of all, the mediation process only takes a few hours to reach a resolution. If mediation is successful, you’ll have a signed agreement that can be enforced by the court if the other party does not live up to the terms of the settlement. And if mediation does not resolve the issue, you still have the option to take legal action.
Business mediation gives both parties a chance to voice their concerns and open up a line of communication to resolve the dispute. It can smooth over misunderstandings and give a person a chance to be heard by the opposing party. By voluntarily participating in a mediation, you can avoid the anxiety and fear many feel about going to court.
How the Business Mediation Process Works
The first step in business mediation is finding a neutral third party to meet with you and the opposing party to help try and work out the agreement. This neutral third party is known as the mediator. The mediator has been trained to help both parties work through their disagreement and find a solution that is mutually beneficial.
During mediation, each side will have a chance to explain their position. The mediator may ask questions during the statement to clarify events. Most times, the parties do not question the other side.
Once each party has spoken, the mediator will then work with each side to attempt to find common ground. The mediator may ask both parties to get together to discuss possible solutions. He or she will talk with each party, proposing solutions and trying to settle the dispute.
At the end of the process, the mediator will then present his or her findings and offer a solution to the issue. If both sides find the resolution favorable, the mediator will draft up an agreement.
