How the Business Mediation Process Works
The first step in business mediation is finding a neutral third party to meet with you and the opposing party to help try and work out the agreement. This neutral third party is known as the mediator. The mediator has been trained to help both parties work through their disagreement and find a solution that is mutually beneficial.
During mediation, each side will have a chance to explain their position. The mediator may ask questions during the statement to clarify events. Most times, the parties do not question the other side.
Once each party has spoken, the mediator will then work with each side to attempt to find common ground. The mediator may ask both parties to get together to discuss possible solutions. He or she will talk with each party, proposing solutions and trying to settle the dispute.
At the end of the process, the mediator will then present his or her findings and offer a solution to the issue. If both sides find the resolution favorable, the mediator will draft up an agreement.
